General terms and conditions

Article 1 - General


The general terms and conditions apply to every offer, treatment and transaction between Sabrina body art and a client to whom Sabrina body art has declared these terms and conditions applicable, insofar as these terms and conditions have not been expressly deviated from by the parties in writing.


Article 2 – Identity of the entrepreneur

Article 3 - Beauty salon efforts


  1. The beautician at Sabrina body art will perform the treatments to the best of her knowledge and ability and in accordance with the requirements of good craftsmanship.
  2. The client ensures that all information that may reasonably be important for the proper execution of the treatment is provided to the beautician in a timely manner.
  3. The beautician of Sabrina body art is not liable for damage of any nature whatsoever arising from the client relying on incorrect and/or incomplete information provided by the client.
  4. The beautician at Sabrina body art will inform the client about the financial consequences of changing the treatment.


Article 4 - Agreements


  1. The client must report any cancellation of an appointment to Sabrina body art by telephone as soon as possible, but no later than twenty-four hours prior to the appointment.
  2. If the client fails to comply with this obligation or fails to comply on time, Sabrina body art may charge the client 100 percent for the agreed treatment.
  3. If the client arrives at the salon more than five minutes later than the agreed time, the beautician may shorten the lost time on the treatment and still charge the client the full fee for the treatment.
  4. If the client arrives at the salon more than ten minutes later than the agreed time, the beautician may cancel the entire appointment and still charge the client 100 percent of the treatment.
  5. Sabrina body art must report any cancellation of an appointment to the client as soon as possible prior to the appointment.
  6. Both parties do not have to comply with the obligations of article 4.1 to 4.5, if they are hindered by force majeure. Force majeure includes what the law and case law say about it.
  7. For online bookings Sabrina body art does not give money back! Here you will receive a valid code of the amount that you paid us online.


Article 5 – Personal data & privacy


  1. The client shall provide the beautician with all information before/during the first treatment that the beautician indicates is necessary or that the client should reasonably understand is necessary for the careful execution of the treatments.
  2. Sabrina body art records the client's personal data and processes it on a customer card, which is then processed in a customer file.
  3. Sabrina body art treats the client's confidential data in accordance with the guidelines in the Personal Data Protection Act.
  4. Sabrina body art will not sell or rent client information to third parties without prior written permission from the client.
  5. Sabrina body art is obliged to maintain confidentiality of all confidential information that the client has shared during the treatment.
  6. Information is considered confidential if this has been stated by the client or if this follows from the nature of the information.
  7. Confidentiality shall lapse if, on the basis of a statutory provision or a court ruling, the beautician/artist is obliged to provide confidential information to third parties.


Article 6 - Payment


  1. Sabrina body art lists all prices of the treatments and products visible in the salon and website.
  2. The stated prices include 21% VAT.
  3. Offers in advertisements are valid for the indicated period and/or while stocks last.
  4. The client must pay for the treatment and any products in cash immediately after the treatment.
  5. Sabrina body art is within its rights to charge 100% of the total amount in case of late cancellation of the appointment by the client. The client must cancel the treatment 24 hours in advance.


Article 7 – Delivery and execution


  1. The entrepreneur will exercise the greatest possible care when receiving and executing orders for products and when assessing applications for the provision of services.
  2. The place of delivery is the address that the consumer has made known to the company.
  3. Taking into account what is stated in article 4 of these general terms and conditions, the company will execute accepted orders with due speed but at the latest within 30 days, unless a longer delivery period has been agreed. If the delivery is delayed, or if an order cannot be executed or can only be executed in part, the consumer will be notified of this at the latest 30 days after placing the order. In that case, the consumer has the right to terminate the agreement without costs and is entitled to any compensation.
  4. In the event of dissolution in accordance with the previous paragraph, the entrepreneur will refund the amount paid by the consumer as soon as possible, but no later than 30 days after dissolution.
  5. If delivery of an ordered product proves impossible, the entrepreneur will make an effort to provide a replacement article. At the latest upon delivery, it will be stated in a clear and comprehensible manner that a replacement article is being delivered. The right of withdrawal cannot be excluded for replacement articles. The costs of any return shipment are for the account of the entrepreneur.
  6. The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a previously designated representative made known to the entrepreneur, unless expressly agreed otherwise.


Article 8 - Liability


  1. Sabrina body art is not liable for damage of any kind arising from the fact that the beautician of Sabrina body art has based her treatment on incorrect and/or incomplete information provided by the client regarding physical ailments, use of medication, work, leisure activities.
  2. Sabrina body art is not liable for loss, theft, or damage to personal property brought to the salon by the client.
  3. Shipping of products is only sent by registered mail, shipping is entirely at your own risk.
  4. Sabrina is not liable if a handmade/knotted hair jewelry. Is damaged if it has been in contact with water or through negligence.


Article 9 – Right of withdrawal


  1. When purchasing products, the consumer has the option to dissolve the agreement without giving reasons for 14 days. This cooling-off period commences on the day after receipt of the product by the consumer or a representative designated in advance by the consumer and made known to the entrepreneur.
  2. During the cooling-off period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he exercises his right of withdrawal, he will return the product with all accessories supplied and - if reasonably possible - in the original condition and packaging to the entrepreneur, in accordance with the reasonable and clear instructions provided by the entrepreneur.


Article 10 – Costs in case of revocation


  1. If the consumer exercises his right of withdrawal, he will be responsible for at most the costs of return.
  2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 30 days after the return or cancellation.
  3. This warranty shall lapse if:

– The client has been informed by Sabrina body art about the result of the treatment and the duration of the effect of the treatment or products;

– The client has used products other than those recommended by the beautician;

– The client has not followed the advice for home care;

– The client has not followed the advice to seek medical help within five working days;

– The client has not used the products according to the advice of Sabrina body art;

– The client has not used the products according to the instructions for use.

  1. After a treatment the skin can react. The client will be informed of this during the treatment.


Article 11 – Complaints procedure


  1. The entrepreneur has a sufficiently well-publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
  2. Complaints about the performance of the agreement must be submitted to the entrepreneur within a reasonable time, fully and clearly described, after the consumer has discovered the defects.
  3. Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within the period of 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed answer.
  4. If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute resolution procedure.


Article 12 - Damage and/or theft


  1. Sabrina body art has the right to claim compensation from the client if the client damages furniture, equipment or products.
  2. Sabrina body art always reports theft to the police.


Article 13- Proper conduct


  1. The client must behave in the salon according to generally accepted standards.
  2. If the client continues to behave inappropriately after repeated warnings, Sabrina body art has the right to refuse the client access to the salon without further explanation.
  3. Sabrina body art works according to the hygiene rules of the HAM code of beauticians.
  4. The client is expected to adhere to personal hygiene rules.


Article 14- Law


  1. Dutch law applies to every agreement between Sabrina body art and the client.
  2. The general terms and conditions are published on the Sabrina body art website.
  3. In the event of any interpretation of the content and scope of the general terms and conditions, the Dutch text shall always be decisive.
  4. The most recently published version or the version applicable at the time the agreement was concluded always applies.


Article 15- Confidentiality


  1. The beautician is obliged to maintain confidentiality of all confidential information that the client has shared during the treatment.
  2. Information is considered confidential if this has been stated by the client or if this follows from the nature of the information.
  3. Confidentiality shall lapse if, on the basis of a statutory provision or a court ruling, Sabrina body art is obliged to provide confidential information to third parties.


Article 16 – Additional or deviating provisions


Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.
